Solicitors and Mesothelioma

Who invented asbestos? There are over three thousands types of asbestos all of which are heat resistant and extremely durable, each are likely to have a different inventor, thus 'who invented asbestos?' … who knows?

Not too long ago asbestos was considered to be the perfect construction material and millions of tons of asbestos materials have been installed into our homes and public buildings worldwide.

It is doubtful that any person involved in the invention and development of asbestos could have foreseen a disease called Mesothelioma or asbestos poisoning. However, there are arguments that in time, many employers would have been aware that overexposure to asbestos would be dangerous, yet failed provide workers with suitable protective gear. They may even have outlined such dangers in a way to negate themselves from liability, but by not providing protection against Mesothelioma the law courts may deem that as an act of corporate manslaughter.

Mesothelioma is a cancer and there is no known cure as yet. Although Mesothelioma can be stopped but only if discovered in an early stage. Mesothelioma lawyers and solicitors will argue that all the money saved by not protecting asbestos workers should be given to surviving workers and their families including compensation for their suffering and provisions for loss of earnings, care and medication.

What are the legal implications of Mesothelioma? Should a solicitor get involved? If you wrote to a former employer and asked for compensation because you or a relative has suffered from Mesothelioma as a direct result of failing to provide adequate protection and duty of care … they are likely to let you know how sorry they are and wish you good luck!

If they have acted in a criminal way, they should be brought to task. Deploying certain safety measures can prevent Mesothelioma; failure to equip employees properly is an offence.

Someone has to convince a jury that the person responsible for the site was aware of the presence of asbestos and equally aware of the consequences it would have on those working within or near to it. What if an employer knew that at some stage he would have to pay compensation? He might have considered the money to be an overhead that may have to be paid but certainly cheaper that stopping the job in hand for health and safety reasons!

Just as an employer has a right to his employee, you have a right to your family. You might not be the person suffering from Mesothelioma, if you are a family member, you too could be a victim. Someone in your family, particularly the suffer, should seek the services of a Mesothelioma solicitor to help gain the financial support you are entitled to and provide the means for a more secure future for your family. You are not seeking a handout, you are seeking compensation for asbestos poisoning through no fault of yours.

Andrew Morgan, solicitor on behalf of asbestos claimants at Field Fisher Waterhouse, examines the scale of the problem and suggests UK insurers plan ahead.
